OVERVIEW

Request for refund of $5000 paid to Five Stars App ​Solutions that resulted in a non-functional and subpar ​app

BACKGROUND

In April 20 2022, NOD and FSAS met on zoom to ​discuss doing an app for them.


On Thu, Apr 28, 2022, 11:36 PM they made their ​first downpayment which implied the acceptance ​to the terms as listed on the payment plan ​agreement.


They refused to sign the initial and final handing ​over strategy workbook that outlines the ​specifications they are claiming today.


However, they did confirm they received all the ​items that were listed on this strategy workbook ​in an email on July 5, 2022. They signed the ​payment plan agreement and the NDA ​Agreement which they are now in breech of by ​claiming for a new company they formed called, ​NurseBridge that they were the creators this app.

THE APP ​INNOVATION

This app was created by a registered company with the ​state of Oklahoma, Five Stars App Solutions, based on ​No-code application Technology, an innovation derived ​from low coded methods through integration, drag and ​drop and code embeds on a coded app building ​platform, Glide.


Among other features, the key aspects of this app was ​created to ensure users can apply to available jobs, go ​through onboarding, pick shifts, approve shifts, post ​shifts and report issues.


The creator, Josette ColePinnix has a Bachelor’s and ​Masters degree in Engineering from North Carolina A&T ​University, started her tech journey in 2013 at Silicon ​Valley with Citrix and successfully completed many tech ​cohorts in 3 years. She is a Six Sigma Greenbelt ​Certified Engineer with the American Society of Quality.

OUR COMPREHENSIVE ​SOLUTION

This solution was built specifically with the ​customer’s vision and goals in mind as stated in ​the Strategy Workbook.


It was originated April 26 2022 BEFORE the app ​was created with all the specifications which was ​not legally agreed on in writing because NOD ​refused to sign on it.

CHALLENGES

Despite having received a highly innovative product, ​Nurse on Demand tried on numerous occasions to sabotage ​the app by claiming false errors and submitting only 3 ​defects to our attention. Their website had a suspicious ​activity alert flagged by Google, and their quality ​claims were falsified evidence.

The first red flag was when between July 18-22 2022 on my trip ​to Ohio for the black Tech week, I noticed a suspicious activity ​flag from Google on their website that was now integrated on ​the app which resulted in the user profile page crashing. On a ​phonecall between Patience, Emmanuel and I they stated they ​will fix it with their developer but were mad that I accused them ​of being scammers when I called them about the issue.

On a 3rd party tracking mechanism implemented by FSAS for all ​reporting incidents, a photoshopped image was uploaded as ​proof of a supposed glitch, which in all my years of tech ​experience had never been reported. The image was falsified ​and contact with the user to troubleshoot said incident was ​prohibited by NOD claiming that I am too rude and not ​professional enough to speak with their clients.

From my years of study and as stated in the American Society ​of Quality methods of calculation of acceptable quality defects, ​taking reports at face value, ie. assuming they were all valid ​issues, 2 reported defects out of 159 transactions done on the ​app does not warranty a quality defect claim. The system is still ​considered efficient with a deficiency ratio of 0.0125

THEIR ​MOTIVES

When they found out how good the app turned out, they ​requested to make it exclusively theirs without signing our ​NDA agreement or agreeing to the terms of an exclusivity ​contract I drafted. They also started requesting for ​unethical operating procedures for the app to complete ​onboarding before theyactually hire the staff. Which ​means they will have access to all user’s documents and ​leave them hanging, no job and pending approvals. When I ​categorically refused these propositions, they ultimately ​said they will not work with me because I did regular audits.


Instead, they went ahead to create a fake tech company ​with no experience telling me they will hire Indian ​Developers who can do whatever they want.

SOLUTIONS

We devised a comprehensive exit strategy for the app ​to be completely transferred from my server to their ​developer’s server and in a meeting we agreed that I ​will no longer be responsible for the management of ​the app. See Video

EXIT STRATEGY- TRANSFER

We therefore agreed that since they did not want to work with me any further, we can transfer the app to ​them in a meeting held on 2.6.23. which Patience Gitau specifically stated they would not need my ​services anymore after the transfer.


The transfer was duly executed on my part. The app was removed from my server and transfer links ​emailed to NOD for action on Feb 10 , 2023 at 8am.


Since then, I have heard nothing from NOD even after several reminders until Oct 24 2023 when they ​reached out demanding refund falsely claiming

that the app does not work.

RESULTS

Our hard work paid off with a 70% app traffic, a 50% ​increase in conversion rate, and an impressive 120% ​growth boost in just five months.

We had to terminate after they refused to sign off on ​Aug 8 and we did not hear back from them until ​February when they requested the transfer.
